Financial Compensation for Work Injuries
 In most cases the employer has an insurance company who must pay for our client’s damages. In the appropriate case, compensation may be paid for the following:
  • Loss of earning 
  • Medical expenses
  • Permanent Impairment
  • Vocational Rehabilitation
Loss of income benefits are normally paid weekly or biweekly. In some cases when benefits are likely to be paid over many years, the workers’ compensation insurance company may be willing to settle for a lump sum.

We understand the financial stress disability from serious injury causes our clients and their families, and consider this in the fees we charge. We will evaluate these types of claims and try to structure a fee that considers our client’s circumstances and the likelihood of success. Social Security Disability Insurance (SSDI) -
Motor Vehicle Accidents and other Personal Injury (PI)
If injuries will keep you out of work for a long period of time, you may be entitled to Social Security Disability Insurance Payments (SSDI).  If you were injured at work because of the negligence of someone not associated with your employer, you may have a separate personal injury claim.  In a claim for SSDI or personal injury no legal fee is paid unless benefits are awarded.
We Maximize Overlapping Benefits from All Claims
 We maximize benefits and compensation from all available sources. If there is a claim for an automobile accident or other personal injury (PI), an on the job work injury and a claim under a disability program or plan, applying the law and regulations is complicated. Disability programs and plans, and claims for personal injury and worker’s compensation frequently overlap. 
We can represent you in your claim for personal injury (PI), Social Security Disability (SSDI), and other types of disability and injury claims such as claims for Virginia Retirement System (VRS) Disability, long term disability insurance (LTD), and workers’ compensation.
The Virginia Workers’ Compensation Act
The Act generally covers anyone injured on a job in Virginia or while working for a Virginia business, a city or state government. (Federal government employees and longshoremen are not covered under the state Act). Any employer who has 3 or more regular employees should have workers’ compensation insurance. If the employer does not, then the injured worker may be able to recover from a special fund call the Uninsured Employers’ Fund. The Act also covers occupational diseases.
The Federal Longshore and Harbor Workers’ Compensation Act (“LHWCA”)
The Longshore and Harbor Workers’ Compensation Act, commonly referred to as the “Longshore Act” or “LHWCA” is a federal statute providing medical benefits and compensation to workers injured on ship terminals, shipyards, docks, piers, and marine ways or who work on or near the water. Workers are covered if they are involved in ship building or ship repair or loading and unloading ships. Benefits under the Longshore  Act are often better than those available under the Virginia Workers’ Compensation Act.

  • I tried the Virginia retirement system on my own and was denied again and again. For my final appeal I hired David Horne and I have to tell you that I could have never done what he did. He made them see medically all of the pain I was dealing with and the detrimental effects that were occurring personally. Without him I would have lost my benefit but with him representing me I was FINALLY accepted as disabled. His fee is not a waste of money and I highly recommend you contact him and see what he can do for you with the Virginia Retirement System. Knowing what I know now I should have used him early in the process, but I had to learn my lesson. You won’t be disappointed!!!!!!!
